PELR Spring 2020 Executive Briefing Highlights Current and Expected Trends

Different issues, topics and concerns emerge in the forefront of PE sponsors’ minds during each calendar quarter. Those can be driven by direct developments in the industry (i.e., SEC examination sweeps) or societal matters with ramifications far beyond the PE industry, such as the ongoing coronavirus pandemic. Macro-level trends often begin to emerge from those developments based on conversations with PE industry participants, including GCs and CCOs of PE sponsors, law firm partners, consultants and others. To summarize those issues for the benefit of our subscribers, Rory Sullivan, Managing Director of Acuris Risk & Compliance – Americas, moderated a discussion with Rorie A. Norton, Editor of the Private Equity Law Report, on the top legal, operational and regulatory issues in the PE industry through Spring 2020 and potential issues going forward. Their conversation touched on issues such as the effect of an industrywide pursuit for liquidity on certain types of transactions, fund structures and financing facilities; the continued prevalence of PE sponsors launching private credit fund strategies, as well as potential risks from the coronavirus pandemic; recent SEC focus areas; operational issues introduced by the coronavirus pandemic; and potential future trends in the PE industry.
